Police Blotter - June 2021

June 1, 2022
While on routine patrol, Officer was dispatched to 3510 N. 9th Street for a property damage vehicle accident involving a van and a SUV with a trailer. Dispatch then update the call and advised that the SUV fled the scene East-bound on Willow Drive. Officers responded to the area to search for the SUV. Officer located SUV at 13th and Avenue K and conducted a traffic stop. I made contact with Officer and the driver, identified as Fabian Alexander Ruiz. It was discovered that Ruiz did not have a valid driver license nor did he have insurance on the vehicle. 
 
Officer changed locations to 9th Street & Willow Drive to speak with victim/driver.
 
Mr. Ruiz was arrested for the hit and run along with interference with official acts as he lied about his role in the vehicle accident. He was also charged for no driver license and no insurance. Photographs of the SUV were obtained. Mr. Ruiz was transported to Pottawattamie County Corrections where he was booked. Vehicle was towed and impounded by Arrow Towing. Trailer was returned to owner
 
Officer was dispatched to the Jump Start gas station for theft. The caller stated a w/m with a gray T-shirt and happy face pajama pants took a fountain soda without paying for it. Clerk stated that the male took the soda and was told not to come back to the store. Officers were dispatched back to Jump Start because the suspect from earlier was back on the property.  
Christopher S. Fox was informed he would be placed under arrest for the theft and for trespassing because he was told not to come back to the property by the employee of the Jump Start. Mr. Fox was transported to Corrections. Mr. Fox was also informed that he was ban and barred from the Jump Start and could be arrested for trespassing again if he returned
 
June 2, 2022
While on routine patrol, Officer conducted a traffic stop on a white Chevy SUV with no license plates at the 1200 block of Locust Street.
 
Nicholas T. P. Palma driver’s license status came back suspended with a license pickup order. Mr. Palma’s license was confiscated and will be mailed to the state of Nebraska. He was cited for no valid driver’s license
 
While on routine patrol, Officer was dispatched to Dollar General Store for a disturbance between a customer and employees.  Upon arrival, Officer spoke with the manager on duty who advised that a male customer, identified a Frederick "Butch" Levell had come into the store to buy some bug spray.
Manager/clerk states when he approached to counter to pay, he produced a $100, he was advised that since the store had just opened, they were unable to accept that large of a bill because they didn't have change for it in the drawer.  She states that Butch advised her that he didn't have anything smaller and showed her a wad of $100 bills from his pocket.  She again advised him that she would be unable to accept the $100 bill.  Butch then advised her he was good for it, which she thought meant he was going to take the spray and come back later to pay.  When she explained to him that wasn't an option, Butch became upset.  She states he was yelling at her, grabbed the spray and threw it across the store and almost struck the FED-EX driver.  She advised him that he needed to leave the store and that she was calling the police.
 
I was advised by Dollar General Store management that they didn't want Butch to come back to the store and wished for him to be served with a ban and bar letter.
 
Butch was advised by Chief Kannedy of this outcome and told he was no longer allowed to come to the Dollar General.  
 
Ban and Bar was completed and copy given to the store
 
Resident came into Carter Lake Police Department to report credit card fraud
 
Officer was dispatched to Super 8 for a burglary report
 
Officers were dispatched to the area of Avenue H and 9th Street for a property damage accident. Dispatch said that a white Nissan Murano bearing the NE license plate hit a pole out of place and the female that crashed the vehicle was on a bench outside of the Prairie Flower Casino and was intoxicated. The female was described as a white female with a floral top.
 
Christina Baker was transported to the Pottawattamie County Jail where she was booked for OWI, interference with official acts, leaving the scene of a property damage accident, and hit & run
 
June 3, 2022
Officer was dispatched to Locust Street to take a burglary report. Investigation continues
 
Officer responded to a verbal disturbance on Cachelin Drive. Adult female was transported in patrol vehicle to the hospital where officer helped her check in and watched her walk into the ER area with hospital staff
 
June 6, 2022
Officer was dispatched to Prairie Flower Casino for a theft report. Caller said their wallet was stolen and Casino security was with the suspect.
 
After investigation, back inside the Casino Officer counted out all the recovered cash on camera (totaling $299) and gave it back to victim. Officer also released her wallet back to her.
 
Nyamuoch G. Chuo was transported to Pottawattamie County Corrections and booked for theft and possession drug paraphernalia
 
Officers were dispatched to Casey’s General Store for a report of theft of alcohol. While in route to location, dispatch advised that the subject, later identified as Tarir Gatuoch, left the area Westbound. I observed Gatuoch East of the intersection at 13th and Locust Street. I made contact with Gatuoch and observed him carrying an open bottle of Tito's Vodka. I ordered Gatuoch to the ground but he was non-compliant. Gatuoch was slurring his speech incoherently and unsteady on his feet. I then drew my taser aimed it at Gatuoch and ordered him to get on the ground and warned him that if he refused he would be tased. Gatuoch complied and I placed him in double locked handcuffs. Sgt arrived on scene. Gatuoch was searched incident to arrest and a further search was done on his backpack to find additional stolen goods and an additional bottle of vodka was discovered. Gatuoch was placed in the caged portion of my patrol vehicle. I obtained pictures of the stolen goods and then Sgt. and I transferred locations to 1650 E. Locust Street.
 
Tarir Gatuoch was transported to Corrections and booked for outstanding warrant, theft, and public intoxication
 
June 7, 2022
Officer was dispatched to the Prairie Flower Casino for an assault that had just occurred. Dispatch said the caller’s wife was just hit in the back of the head with a fist by another male with long hair who was still on location.
 
Based on the security video and the statements, I issued Rodney Smiley a criminal citation for Assault. He signed and understood the summons, he was issued a ban from the Casino by staff for 96 hours. I put in a request for the video footage for evidence
 
Captain was on patrol in the City of Carter Lake when he received a call at the station from victim, Dustin Terry, who advised he was at the Prairie Flower Casino playing the slot machines. During this time, he dropped his cell phone on the floor without knowing it.  He states that when he noticed it was missing, he went back to the machine he was playing and checked the floor around it, but the phone was not there.  At this time Dustin tells me that he made contact with security who advised him they would look at the cameras.
 
Dustin tells me that security was able to see his phone being taken, but Security wouldn’t provide the information to him and told him to call police and file report.
 
At this time I proceeded to the casino to speak with surveillance. 
 
At this time, I am requesting a warrant for Lah Thay on the charge of Theft 3rd
 
Captain was on patrol in the City of Carter Lake when he was dispatched to 3510 N 9th Street, to assist rescue with a cardiac arrest patient.  While enroute, I was advised that the male party was on the floor unconscious and not breathing
 
CLVFD member Phill Newton arrived on scene and pronounced adult male deceased at 1537.
 
Scene was turned over to medical examiner’s office and funeral home.
 
June 8, 2022
Officer was contacted by security at the Prairie Flower Casino that a female with a warrant was on location. 
 
The female was identified as Sommer Lynn Cudaback. Upon checking with dispatch, she had a valid warrant for through Pottawattamie County. I made contact with Sommer in the casino and had her walk outside with me. I advised her of her warrant and placed her in two sets of handcuffs. She was transported to Pottawattamie County Corrections where she was booked on her warrant, a return of service was completed
 
Officers were dispatched to 9th and Avenue Q to assist the fire department with an unresponsive male. Upon arrival I observed Emergency Medical Service Members providing care to the male, later identified as Devin Barfield. I observed Barfield sitting upright on a playground bench. As I approached the scene an unknown female approached me and said that she called 911 because she was concerned, as Barfield had been laying on the park bench for over an hour. She further elaborated stating that she had driven by the playground and observed him lying on the park bench and when she drove past again, an hour later, she observed him still laying there. She said at that point she attempted to verbally rouse Barfield, but he did not respond. Mr. Barfield was transported to Corrections and booked for public intoxication
 
Officer Bentzinger was on a traffic stop at 800 E. Locust St. when residents pulled up next to him and advised that their son had found a firearm in the lake and that they had it at their house. I transferred locations to that address and made contact with them. They showed me the firearm which was laying on their kitchen table. The firearm was completely covered in lake mud. The chamber and action were completely compacted and I was unable to render the weapon safe. At that time the residents’ were not exactly sure of the location that the firearm was pulled from the lake but they knew it was in the area near Mabrey Park
 
Also based upon my search I was able to determine that the serial number was filed off. I entered the firearm into evidence
 
June 9, 2022
Sgt. Gonsior was instructed to call Jay Gundersen at Carolina Drive to file a vehicle burglary report.  Jay was no longer at his residence at this time.  I spoke with Jay over the phone and he stated sometime between the hours of 2130 hours and 0630 hours on Wednesday June 8 into Thursday June 9th an unknown individual entered his truck.  Jay stated that the only item missing was loose change, approximately $100.  
 
Jay checked his house but did not see any items missing.  It is unknown if the home was entered
 
June 10, 2022
Officer was dispatched to Lakeside Mobile Home Park for a two vehicle property damage accident.   Upon arrival I spoke to the caller who was then identified as Alexander Wade who stated that he was driving vehicle #1.  While he was traveling southbound stopped at a stop sign at the intersection of 13th Street & Willow Drive. While stopped Alexander stated that he watched as vehicle #2, which was a black Kia Soul, drove into the back of his vehicle.  Alexander stated that this contact caused minor damage to both vehicles and no one got injured during this situation.  Prior to my arrival both vehicles were moved off the traveled portion of the roadway to a safe location.
 
I also spoke to the driver of vehicle #2 who will be identified as E.R. who stated that she was driving southbound on North 9th street.  E.R. stated that as she was approaching the intersection she took her eyes off the roadway for only a split second.  E.R. stated that when she looked back onto the roadway vehicle #1 was sitting at the stop sign and she simply just ran into the back of his vehicle.  No injuries where sustained by any party in either of the vehicles.   
 
E.R. was given a citation for following too closely since she didn't have enough time to stop before making contact to the first vehicle with hers. E.R. stated that she understood the citation and what she needed to do with the citation
 
Officers were dispatched to Lakeside Mobile Home Park for a trespassing call.
 
Alexander Schroder was issued a criminal citation for trespassing. Officer explained citation, he stated he understood and signed his copy. He was then allowed to leave on foot
 
Tiffany Sackett was transported to Corrections and booked for possession controlled substance and trespassing. Contraband was photographed and logged into evidence
 
Officer was dispatched to Country Inn & Suites for theft from a vehicle call. Victim did not have any suspect information. There was no obvious physical evidence at the scene. This case is being closed due to lack of any suspect information
 
June 10, 2022
Officer was dispatched to Locust Street for a burglary report. Victim contacted Officer that his wallet has been found
 
While Officer was on call at Lakeside Mobile Home Park, resident notified him that the trailer behind them has had an open door for a few days. The little boy had also told me that it had a shattered window on it, I had them point out the trailer to me.
 
Officers cleared the trailer which appeared to be heavily vandalized, every room in the trailer had holes in the walls, broken windows, and personal items as well as trash everywhere. In the main living room there was a tire iron and a crowbar on a shelf which we suspect to be how the individual(s) got in. In the back bedroom in the window with the holes Officer’s found the entry holes to be much smaller, metal bb’s were found in the window and some on the floor. A C02 canister was found on the kitchen counter suspecting that a C02 BB pistol was shot several times in the home.
 
The crowbar, tire iron, and C02 canister were collected as evidence, everything was photographed and placed into this case. I am having supervisors on day shift notify the proper management during the day, I placed police tape at the entrance to the trailer.
 
Nothing further at this time and no suspects
 
Officer was dispatched to Lakeside Mobile Home Park for a theft report. Officer attempted to make contact with suspect but was unsuccessful
 
June 12, 2022
While Officer was on mobile patrol traveling Northbound on 9th Street near the 3000 block. I observed a gold Ford Escape traveling Southbound on 9th towards me and striking the West side curb. I turned around to follow the vehicle. The vehicle was weaving in and out of the Southbound lane. The vehicle stopped at the stop sign at Locust St. and turned Westbound. I followed and activated my emergency lights. The vehicle again struck a curb on the North side of the road. The vehicle continued on to the stop sign at 5th St. and then turned North. As the vehicle turned, it swung very wide and into the opposite lane of traffic before finally coming to a stop on the East side of 5th Street. I made contact with the driver Sonya Baker. Baker immediately informed me that she doesn’t see well at night and has Glaucoma. After requesting appropriate documentation, I asked Baker how much she had to drink. Baker admitted to having drank one or two beers. Sgt. arrived on scene. Vehicle was towed and impounded. Sonya L. Baker was transported to Corrections and booked for operating while intoxicated. Further contraband was discovered by Corrections staff
 
Sgt. was dispatched to Casey’s General Store for a female transient that would not leave and is bothering customers. The business stated that they would like her removed and banned from the property.
 
Upon arrival Sgt. made contact with Gail Williams that was already talking with Officer Bentzinger. Officer Bentzinger checked Gail for warrants and found that she had warrants out of Florida that were not extraditable. I informed Gail that the business wanted her to leave the property and that she was not allowed to return or she would be arrested for trespassing.
 
I issued Gail her ban and bar paperwork that she signed and agreed that she understood. She then left the property. No further contact was made
 
Officer was on mobile patrol at 5th and Locust Street when I observed a white Buick LaCrosse traveling Westbound with expired tags. I initiated a traffic stop and the vehicle stopped in the parking lot of Shoreline Golf Course. I made contact with the driver Richard Koester Jr. and discovered that Koester had a suspended license with a pick up order. I also learned that the vehicle was uninsured. I cited Koester for expired tags, no driver license, and no insurance. I seized Koester's license. Vehicle was towed and impounded
 
June 13, 2022
Officer was on patrol in full uniform and driving a marked cruiser. I was sitting stationary at the 400 block of Locust Street. I observed a gray Hyundai Elantra with Nebraska plates traveling Eastbound on Locust Street from the 100 block. As the vehicle passed me I observed that the license plate lamps were not working. I activated my emergency lights to conduct a traffic stop at the 900 block of Locust Street. After activating my emergency lights the driver later identified as Zarazua-Hernandez, Nadim continued to drive East bound on Locust Street for two blocks eventually pulling up to a gas pump at the Kwik Shop located at 1202 Locust Street.
 
I explained to Nadim the reason I had stopped him and he stated that he didn’t have a valid driver’s license and that he had a warrant for his arrest out of Bellevue, Nebraska.  I asked what the warrant was for and he said it was for traffic offences.  I explained to him that more than likely they will not extradite him for those warrants.  I asked if he had any Identification on him and he said it was in his left cargo pocket.  I retrieved his wallet and located his Nebraska ID card. 
 
I returned to my cruiser and ran Nadim through NCIC which showed he had a non-extraditable warrant out of Sarpy County Nebraska and a revoked driver’s license. 
 
I returned to Nadim who was standing with Sgt. Chambers and took his handcuffs off as he had calmed down.  I issued him a warning citation for the registration plate lamp and a citation for operating a motor vehicle without a valid driver’s license.  I explained both citations to him and he stated he understood them and signed for his copies
 
Sgt. Gonsior was dispatched to the Kwik Shop for a female in the store trespassing and harassing customers.  I arrived and spoke with Kwik Shop staff who stated the female was over by the water fountain.  I went over to the water fountain area and made contact with Gail Williams.  It should be noted that this officer asked Gail to stay off the Kwik Shop property from an earlier call in the day because she was harassing customers per employee.  The Kwik Shop requested that she be banned from the property.
 
I filled out a ban and bar form and explained to Gail that if she goes back onto the Kwik Shop property she can be arrested for trespassing.  Gail signed the form and stated that she understood and would not come back on the property.  A copy of the ban and bar was given to the Kwik Shop and placed into the case file
 
June 14, 2022
I Officer Owens, Matt (#913) was on patrol in full uniform and driving a marked cruiser. I was sitting stationary at 9th Street and Ave. J when I observed a silver Chevrolet Tahoe with Nebraska plates traveling South- bound on 9th Street from Locust Street. As the vehicle passed me I observed that the vehicle had no working license plate lamps. I activated my emergency lights and conducted a traffic stop in the parking lot of the Prairie Flower Casino.
 
I made contact with the driver later identified as arrestee Justin Warnaca and his female front seat passenger later identified as Kolina Warnaca. I advised them of why I had stopped them and requested to see Justin’s driver’s license, vehicle registration and proof of insurance. I also requested to see Kolina’s identification as well. Justin was only able to provide me with his prison identification stating they did not have any of the vehicle’s information. Kolina was able to provide me with her Nebraska ID.
 
I returned to my cruiser and ran both subjects through NCIC. It showed Justin as having a revoked driver’s license out of Nebraska and a possible warrant out of Council Bluffs, Iowa. Kolina came back with a suspended driver’s license out of Nebraska and no outstanding warrants. I contacted the Pottawattamie County Communications Center and requested they confirm the warrant for Justin. A few moments later they stated that his warrant was confirmed and valid.
 
I returned to Justin’s vehicle and had him step out. I placed him in handcuffs, checking for a proper fit and double locking them. I advised him of his valid warrant and told him he was under arrest. Justin was placed in the rear caged portion of my cruiser. 
 
I returned Kolina’s identification and told her why Justin was going to jail. She was then allowed to lock the vehicle up and enter the casino. 
 
I transported Justin to the Pottawattamie County jail where he was booked for his outstanding warrant and operating a motor vehicle without a valid driver’s license
 
Sgt. Gonsior was dispatched to the Country Inn and Suites to take a no contact order violation report. I arrived and spoke with the victim Lesli Martinez-Balanzar. Lesli is also an employee of the Country Inn and Suites and was working the front counter reception area at the time of the violation.
 
Lesli stated that her ex-boyfriend De’Von Pierce who is also the father of her son continuously calls the Country Inn and Suites and harasses her about seeing his son. 
 
This officer will apply for a warrant for the no contact order violation.  The Pottawattamie County dispatch confirmed the valid No Contact Order with the Douglas County Nebraska communications center
 
June 16, 2022
On Thursday June 16, 2022 at 0201 hours I Officer Owens, Matt (#913) was on patrol in full uniform driving a marked cruiser. I was sitting stationary at 9th Street and Ave. J facing East with my headlights and take down lights on. I observed a white Chevrolet Trailblazer traveling South- bound on 9th Street. As the vehicle passed me I observed the driver later identified as Rebecca Fletcher sitting very far forward in the driver’s seat. She had approximately 6 inches of space between her back and the seat. She was also staring straight ahead without looking around. I also observed that the vehicle’s license plate lamp was not functioning. I activated my emergency lights and conducted a traffic stop at 1031 Ave. H in the Prairie Flower Casino parking lot.
 
I returned to my cruiser and ran all three subjects through NCIC. Fletcher’s information came back with no outstanding warrants and a suspended driver’s license out of Nebraska. When adding her information to the call, her name card advised she was a known narcotics user. Neither Corliss nor Blackerby had any outstanding warrants. While running their information I observed Fletcher was unable to stand still and was pacing constantly while smoking a freshly lit cigarette.
 
I issued Fletcher a citation for operating a motor vehicle without a valid driver’s license and a warning citation for the license plate lamp.  I explained both citations to her and she stated she understood them and signed for her copies. 
 
I advised Fletcher that my traffic stop had been concluded but that she was still being detained for a criminal investigation. I then asked for consent to search her vehicle which she denied. I told her that I would be deploying my trained Police K9 to conduct a free air sniff around her vehicle. I had Corliss and Blackerby step out and stand with Fletcher and assisting Officer Bentzinger.
 
During the probable cause search of the vehicle no contraband was found.  All parties were allowed to leave at this time
 
Officers were dispatched to Lakeside Mobile Home Park for an assault. The caller stated her mother had punched her in the nose and was refusing to give her 11 month old child back to her. Dispatch also stated the caller was intoxicated.
 
Upon arrival, Officer Bentzinger was speaking with the caller and subsequent arrestee, Shyann Carey. She was seated in the front seat of a vehicle parked along the curb next to Lot 83. Once Officer Bentzinger had her get out of the vehicle, it was immediately apparent that she was highly intoxicated as she was unsteady on her feet, slurring her words and smelled of an alcoholic beverage (public intoxication). Officers Bentzinger and Dargy spoke with Shyann while Officer Huscroft spoke with the other people involved.
 
Shyann Carey was transported to Pottawattamie County Corrections by Officer Bentzinger where she was booked for public intoxication, interference with official acts, and possession of alcohol (by consumption) by person under 21 since she is 19 years old.
 
Infant remained with family members. Report will be faxed to DHS

June 17, 2002
Officer was dispatched to Lindwood Drive for a criminal mischief report. Dispatch said his ex who now lives next door vandalized his yard, but was not currently on location.
 
Victim had no video proof that suspect went into his yard and made the mess, but he did want a report done on the incident. I advised him to contact the Sheriff’s office and make sure she is legally no longer a resident in the home and has surpassed the number of days for her to get property, if he wishes to have a trespass notice issued to her then we would be able to at that time.
 
I then spoke to suspect at her parent’s house, she denied ever going through the stuff in the backyard. I advised her of the situation and she understood
 
Sgt. Gonsior was dispatched to the Carter Lake, Iowa Police Station to take a trespassing report.  I arrived and met with Jenny. To get to the back door the unknown suspect needed to walk through a gated 6 foot tall wooden privacy fence.  The video clip only shows the male party standing at the back door and then leaving the property.  
 
Jenny stated that this incident was brought to her attention by homeowner’s son.  Jenny will be sending this officer a copy of the video to post the image of the suspect onto social media for possible identification.
 
Jenny also stated that homeowner parks his motor home on the east side of the home and when she arrived this morning the door to the motor home was open.  Jenny went inside but could not tell if anything had been taken or disrupted.  This officer also looked inside of the motor home and nothing appeared to be tampered with.
 
Officer spoke with homeowner. It is unknown if the suspect made entry into the home.  Homeowner stated that nothing appears to be missing or disrupted in his house.  This officer will follow up with both homeowner and son if a suspect can be identified. End of report
 
June 17, 2022
Sgt. Gonsior was dispatched to 3510 N 9th Street for a suicidal male who has diagnosed mental issues and he has made threats of self-harm in the past. He could hear her on the phone with 911 so he left the residence with the knife.
 
     Officers drove in the area for 45 minutes and located the male. The male admitted to having a knife and throwing it on the ground somewhere in the Lakeside mobile home area.
 
Male was transported to Mercy Hospital in Council Bluffs, IA
 
June 18, 2022
Officer was dispatched to 9th Street & Steele Avenue for a stolen vehicle that was traveling South-bound on Ninth Street.  I met the vehicle in question which was a silver 2011 Chevy Traverse license plate Nebraska at 9th and Avenue K where I pulled behind this vehicle and activated my emergency lights. This vehicle then started to speed up as to attempt to get away as they proceeded down Avenue K towards 13th Street.   As I was attempting to catch back up to this vehicle I was advised that the driver was a 15 year old female driving the vehicle.  Due to the driver’s age and the possibility of continuing high speeds I decided to discontinue the pursuit. I shut my emergency lights off but I did continue to follow the suspect vehicle at a safe distance behind it.  
 
I then stepped in between the door and the car as I ordered L.G. out of the car again to which she screamed not to touch her as she pulled away from me.  I then was able to grab her left arm and place her hand in one handcuff. As I was attempting to handcuff her she kicked me in the chest three different times.  I was then able to remove L.G. from the car where I then escorted her to the ground and I was then able to finish handcuffing her.  
 
I then checked the cuffs for proper fit and for them being double locked.  L.G. was then escorted to my patrol vehicle where the handcuffs where checked again for proper fit and they were re-adjusted looser.  At that time I was able to see a very small scrape on the wrist of her left arm that was a little red.  I requested communications to dispatch fire and rescue and to have them respond to my location so they could check/treat L.G. before I took her to the Southwest Juvenile Detention Center.    L.G. was then secured in the back of my patrol vehicle while I waited for fire and rescue and I started my investigation of the situation and while I gathered the callers’ information.
 
It was determined that the only thing that could be and needed to be done for the cut was to put a small amount of gauze on it to protect it from being irritated by the cuffs.  Fire and rescue stated that they would fax a couple of the medical release forms to JDC in case they needed that information before L.G. was able to be booked in.   
 
After fire and rescue treated L.G. she was once again secured in my patrol vehicle.   I then notified a juvenile court officer of the situation to confirm that they would take L.G. on those charges.  I talked to the JCO who was then identified as Chelsea.  Chelsea stated that they would definitely take L.G. and to go ahead and transport L.G. to JDC.  This vehicle was returned to the caller and registered owner.  A photo of the cut will be also placed into evidence.   I then transported L.G. to JDC where she was booked in for assault on a peace officer, eluding, driving a vehicle without a valid driver’s license, and for being a missing/runaway out of Nebraska
 
Suspect vehicle was stopped for a license plate violation. The driver was found to have a suspended license through Nebraska with an active "pick-up" order. The driver, Je’Lynn D. Smith-Woodfork was issued a written warning for the plate violation and a citation for no valid driver’s license. The driver's license was seized and sent back to the Nebraska DMV
 
Officer was contacted by Chief Kannedy, who was working off-duty security at the Spearmint Rhino. He had located a wallet in the parking lot. Inside the wallet were four credit/debit cards and two state IDs. Chief Kannedy said he checked with staff at the business and the wallet owner was not inside. The ID showed an address out in York, NE. We were not able to locate any other contact information. Chief Kannedy instructed me to secure the wallet and its’ contents in property for safe-keeping, which I did upon my return to the Police Department
 
During the week of June 13 resident stopped into the police department to share information of a property dispute between his neighbors and himself, on Shoal Drive.
 
Resident informed me that he had a survey done on the property lines and that it did not match up with the original from when he purchased the property. Thus causing a “broken survey” because it was in dispute. He said the only way for the dispute to be settled is that the two property owners would have to come to an agreement. He informed me that when the survey came back the neighbors started landscaping in the area that is disputed. I asked him what the survey came back as and he stated that it came back eighteen feet in favor of the neighbors in the area that they are landscaping.
 
I informed him that if the property is in dispute that it was a civil matter and would need to be handled through the court system. If it became a criminal matter then we would be able to get involved.
 
On June 18 Resident informed Sgt. Gonsior that he would be removing the landscaping off of his property and that he had placed no trespassing signs on the property that he believed was his
 
On June 19, 2022 at approximately 0814 hours neighbor met at the police department and informed me that in the middle of the night resident had removed all of the landscaping and put up and black plastic barrier between the properties and 18 feet onto her property that is the disputed land. Resident had bushes planted where the neighbor’s landscaping had been removed and grass seed planted.
 
I asked if they had contacted an attorney and she said that she had and she was told that the police could not do anything and not to have any interaction with resident. Neighbor was visibly upset and crying and asked if I would document her visit. I also went to the properties and took photos that will be uploaded to the report
 
Officer Matt Owens was on patrol in full uniform and driving a marked cruiser. I was flagged down by a citizen advising there had been someone riding a bicycle in the field in the 3400 block of 9th Street. They pointed to where I could just make out the handle bars of a bike laying down. I drove my cruiser into the field and observed a Hispanic male laying on the ground with the bike partially on top of him. I could also see he was bleeding from a scratch on his ankle and a scratch on his right hand. 
 
I was able to wake the male later identified as arrestee. When he woke up he immediately asked “what am I doing out here”.  I told him I didn’t know. He then asked where he was. I told him he was in Carter Lake, Iowa. He said he just wanted to go home so I asked where home was and he said 3510 N 9th Street. I was familiar with this address from multiple previous calls. I asked what his name was and he said John Soliz. I asked if he had been drinking and he said he had had 2 beers. I asked how long ago he had consumed those beers and he didn’t know. I asked him what time he thought it was and he said about 1730 hours. I advised him it was actually 2100 hours. I asked him to spell his name and provide his date of birth which he did. 
 
I ran him for any outstanding warrants through dispatch and they advised he had no warrants on file. I asked John if he would submit to a portable breath test (PBT). He stated that he would. I instructed John on how to take the PBT and he provided a sample, which registered .164 breath alcohol concentration (BAC). I placed John in handcuffs, checking for a proper fit and double locking them. I told John he was under arrest for public intoxication and placed him in the rear caged portion of my cruiser. 
 
Assisting Officer Swinarski, Adam placed John’s bike and the items from his pockets in his cruiser and transported them to 3510 N 9th Street. I transported John Soliz to Pottawattamie County Corrections where he was booked for public intoxication. While in route to corrections John became extremely upset stating he wanted to die and was striking his head against the cruiser cage. 
 
At Corrections I received assistance from 2 Correctional Officers as John fell to the floor and refused to get up. He was carried inside, placed in a cell and was left in the care of correctional staff. Nothing further at this time
 
 
June 20, 2022
Officer Huscroft was on duty for the Carter Lake Police Department. At approximately 1912 hours, Officers were dispatched to 3510 N. 9th Street for a disturbance between a male and female. Dispatch stated a male got out of a dark grey Chevy Equinox (NE/VSV908) and struck the caller. He then left the area.
 
Witness corroborated everything caller stated.
 
At approximately 2027 hours, Officer Bentzinger and Officer Huscroft were dispatched to Wavecrest Park (500 Ave Q) for a disturbance. Dispatch stated caller had located the suspect vehicle at Wavecrest Park and was now in a verbal disturbance.
 
Officers spoke with the occupants of the Dodge Journey. The driver was identified as DA and the passenger was BH. When asked about the initial disturbance, DA said that they were driving north on Cuming St/Abbott Drive to go to Wavecrest Park. As they were driving, they noticed a vehicle tailgating them extremely closely. The vehicle then went around them and cut them off somewhere on Abbott Drive. When the vehicle cut them off, it came very close to striking them. The vehicle was a blue Nissan Versa and was driven by caller. They both stated that caller was driving extremely recklessly from Abbott Drive onto Locust Street. DA said he followed caller into the trailer park to get her license plate to call 911. Once near the lobby of the park, caller parked and yelled for BH to get out of the vehicle. They continued to yell at each other and caller told them they were being recorded. DA then reached into the vehicle and knocked caller’s phone off of the mount onto the floor. He said his arm/hand never struck caller. DA said they then proceeded to Wavecrest Park. After a while they noticed caller driving around the park several times looking at them. They then sent BH’s mother to ask caller what she was doing.

Sgt. Gonsior was approached at the Carter Lake Police Station by city employee, Robin Conner.  Robin drives a shuttle van for the senior center.  ROBIN stated she was driving east from 13th Street on Dorene Blvd.  At 1321 Dorene Blvd. which is on the south side of the street sits a portable basketball hoop that is sitting on the city right of way grass in between the street and sidewalk.  The city van Robin was driving sits very high off the ground.  Robin stated when she passed by the area of the basketball hoop she could hear the basketball hoop strike the passenger side of the van.  Robin stopped to see if there was damage but could not see any.  The basketball hoop remained upright with only rocks sitting on the base of the hoop. Photos were taken
 
Robin stopped at the Police Department to notify us about the incident and was concerned the basketball hoop might strike another vehicle.  This officer went out to look at the van and could see a baseball sized dent on the passenger side upper rail next to the windshield.  We met back at the accident location and pictures were taken of the van next to the basketball hoop.  It is possible the rim area or the backboard area of the hoop caused the damage.  The rim sat an inch higher or so from where the dent was at and there was no fresh paint transfer from the black rim onto the white van.  The backboard area sat a little lower, but again there was no fresh black paint or scuff from the backboard.  This officer looked on the roof area of the van and could see long scratches on the passenger side rear of the van roof.  Robin stated she has had tree branches hit the top of the van as she drives past them, so this is possibly what caused that. Sgt. Gonsior was dispatched to 3510 N 9th Street for a homeowner that received dog bites to her hands.  I arrived on location with Carter Lake Rescue and met the victim, out in front of her residence.  Tonia stated her two boxer puppies were fighting inside the home with each other and she decided to intervene.  While separating the animals she was bit on both hands causing deep lacerations which will require stitches.  Tonia refused transport and decided to drive herself to the hospital.  Animal control was notified.   Both dogs were left inside the home in their separate kennels.  Photos were taken of Tonia's injuries. Sgt. Gonsior was contacted by 10 Roads Logistics LLC to take a fraud report.  10 Roads Logistics LLC is located at 200 Owen Parkway Circle and is associated with Lone Mountain Truck Leasing.  Sgt. spoke with account for 10 Roads Logistics LLC. Investigation continues
 
Officer was dispatched to Jump Start gas station for the employee requesting two individuals to be ban and barred from the property.
 
When I arrived I talked with the clerk that pointed out a b/m that I knew as Elijah Emery and a w/f Michelle Lasley that were walking away from the dumpster on the west side of the building. The clerk told me that Lasley had vandalized the bathroom on a different date and Emery digs through the dumpster leaving trash all over the ground. She stated that she wanted them ban and barred from the property.
 
I made contact with Lasley and Emery and informed them of the complaints and that they are being ban and barred from the property. I informed them that if they return to the property for any reason they can be charged and arrested with trespassing. They both stated that they understood and signed the ban and bar paperwork. I provided them a copy of the ban and bar and they left the area.
 
I had the clerk sign the ban and bar as a representative of Jump Start and provided her a copy of both forms. Nothing further
 
June 23, 2022
Sgt. Gonsior was dispatched to 3510 N 9th Street to take a threats report.  I arrived and spoke with the homeowner who showed officer a message she received from a man named TRAY.  TRAY is believed to do work in the Lakeside Mobile home area and knows homeowner’s ex.  The message is allegedly from ex to TRAY stating he is dying and when he gets out of the hospital and he is finished with the doctors he is going to come back an  kill everyone.  The message does not say where he is going to come back to or who he is going to kill or how.
 
Homeowner is worried ex will come back to her home
 
Officers were dispatched to Country Inn Hotel in regard to an armed assault, which had just occurred. The caller was an employee from the Hotel. She stated there was a male with a knife threatening several juveniles in front of the business. The suspect was described as a white male wearing a blue tank top and jeans. He had previously been on a bicycle, but was currently walking toward the Holiday Inn Hotel. He was armed with a large knife and had threatened to stab the juveniles. He was last seen near or behind the Holiday Inn.
 
Upon officers arrival we checked all three hotels in the area, Abbott Drive and surrounding areas with negative results. I made contact with the victims at Country Inn. There were three victims identified. They stated they had been riding the electric community scooters north on Abbott Drive from 10th Street in Omaha back toward the Country Inn where they were staying with their parents. They passed a male on a bicycle who began to follow them. They crossed Abbott Drive in an attempt to get away from him, but he continued to follow on his bike while yelling threats and profanities at them. When they reached the hotel complex they got off the scooters and began to run toward the Country Inn. The suspect fell off his bike and began to run after them saying he was going to shoot them. The three victims began to yell for help as they ran. This caught the attention of a gentleman as he exited the Country Inn. He asked what was wrong and the boys told him about the male chasing after them saying he was going to shoot and kill them. The boys ran to the entrance of the Hotel while the gentleman stood in front of them as the suspect approached. The gentleman told the suspect to get back and that he was not going to let him enter the hotel. The suspect stepped back and drew a knife from a sheath on his belt. The knife had a fixed blade and was approximately 6 inches long. The suspect told the gentleman he only “wanted” the boys and began to waive the knife around in a threatening manner. The gentleman said they were going to call police and told the suspect to leave. The suspect then ran back toward the Holiday Inn while the employee at the Country Inn called police.
 
I spoke with the gentleman and the Country Inn employee who all confirmed the boys’ statement.
 
The three victims all called their parents who responded to the scene and were informed of the incident. Friends of the victims reported seeing the suspect in front of the Hilton Hotel on 10th St in Omaha. Omaha Police were notified, but the suspect was never located or identified.
 
At the scene the victims were all released to their parents and given cards with the report number. The victims and their parents all wish to pursue prosecution if a suspect can be identified. Nothing further.
 
June 24, 2022
Captain J. Driscoll was on patrol in the City of Carter Lake.  Officer was dispatched to Casey’s General Store for a male party trespassing.  While enroute, I was advised there is a B/M wearing a white t-shirt and tan pants on location asking people for money.  I was also advised that employees have asked him to leave several times, but he refused.
 
Upon arrival I spoke with manager, Matthew.
 
He advised that this male party has been coming to the store for the past 2 days and harassing customers.  They have asked him several different times to leave, but he keeps coming back.  They stated at this time they wished to have him served with a ban and bar. I was able to locate the male party, identified as Deni Jordan, at 21st St E/Locust St right by the Open Door Mission.
 
I advised Deni why I was speaking with him today and what Casey's employees had told me.  Deni advised me that he has been going to the store to ask customers for cigarettes.  I advised him he can’t do that and they now are having him served with a ban and bar from the property.
 
While collecting his information for the report, I discovered that Deni is listed as a missing person out of Omaha.
 
Due to my location, I asked for dispatch to send OPD to my location.
 
Upon their arrival, I advised them of what I had found.  They ran his information through their system and found the entry.  They advised me that since he is 28 years old and they have physically seen him, they are going to remove the entry and he can be let go.
 
Deni was issued his ban and bar which he stated he understood and allowed to leave
 
Captain J. Driscoll was on patrol in the City of Carter Lake.  I was advised there was an abandoned bike in the lot next to 104 CLC.  Upon my arrival to the area, I located a Purple Schwinn Hurricane bike laying in the grass.  I checked the bike for any registration tags or owner information, but none was found.  Bike was to be transported to the maintenance yard for storage. Before maintenance picked up the bicycle it disappeared
 
Captain J. Driscoll was on patrol in the City of Carter Lake and was dispatched to Manuel's Tire Shop for a theft report.  While enroute, I was advised that a B/M driving a silver sedan with NE plate, left without paying for his repairs.  They advised that the vehicle was last seen heading West on Locust St into Omaha and that this occurred about 10 minutes ago.
 
Upon arrival, I spoke with caller/employee who tells me that the male party was upset about the repair and how what he wanted done couldn't be.  Isaac states that after the male party was told there was nothing more he could do, he was informed that he owed $13 for the repairs that were done.  This upset the male party who got into his car and left.  
 
Upon running the plate through NCIC, it comes back to A. Williams out of Omaha. I have attempted to look A. up on Facebook in an attempt to reach him, but was unsuccessful. On a later date this officer will drive to the registered address to see if A. still resides there. Nothing further at this time
 
Officer J. Huscroft was on duty for the Carter Lake Police Department. Officer received a phone call from Sgt. Chambers, who said he had just received a phone call from Lakeside Recyclers about a theft that had just occurred.
 
Sgt. Chambers said a white male on a bicycle had just stolen $600.00 from the window at Lakeside Recyclers. He then left the area on his bike. He was described as a shirtless white male with several body tattoos and a goatee full of rubber bands. I checked the area for the suspect but did not locate him. Lakeside Recyclers was closed at this time so I was unable to contact anybody there.
 
A few moments later I saw the owner of Lakeside Recyclers, Mike Levell, parked in the parking lot at N. 9th & Locust Street. I had contact with him about the theft. He said the suspect took a $600.00 ticket from a customer at the window. Mike thought he recognized the suspect and thinks CLPD would be able to identify him. Mike said he wanted to press charges and said to stop by sometime tomorrow to get video footage.
 
I will follow up with Lakeside Recyclers tomorrow when I return to work. Nothing further at this time
 
Officer Nate Bentzinger was on duty at the Carter Lake Police Station when I was advised by Officer Jake Huscroft to follow up with M. Jensen about a prior case. I called Jensen and she reported that her tires had been slashed and suspected Graham C. of being responsible. I responded to Jensen's residence and made contact with Jensen. I observed Jensen's Honda Civic having two flat tires on the passenger side. Upon further inspection I could clearly see a slash in the front passenger side tire. The slash appeared to have been caused by a knife. I also saw a puncture on the rear passenger side tire. I obtained photos of the tires. Jensen believed that Carr was living in the area and had an on-going grudge with Jensen. I provided Jensen with appropriate case information and departed property. End Report
 
Officer Huscroft was on duty for the Carter Lake Police Department. At approximately 2147 hours, I observed a silver 2006 Hyundai Sonata traveling westbound on Locust Street from the 500 block. One of the headlights was not working and the driver’s side brake light was out. I activated my overhead emergency lights, initiating a traffic stop at the 100 block of Locust Street.
 
Upon initial contact with the driver, she identified herself as Zoey Bieranowski through a Nebraska driver’s license. She provided the vehicle’s registration but was unable to find an insurance card. I then returned to my cruiser to run Zoey and the vehicle through NCIC.
 
A computer check of Zoey showed that her driving privileges were suspended out of Nebraska with a license pick up order. A computer check of the car showed it was not stolen and it also showed that it had current insurance. While in my cruiser I completed a traffic citation for Zoey for failure to have a valid license to operate a motor vehicle and a warning citation for the brake light.
 
I then explained the issued citations to Zoey and she did sign them. I informed her that her license will be sent back to the Nebraska DMV and she would have to contact them to get it back. Nothing further
 
Officers were dispatched to 3510 N 9th Street Lot 136 for a disturbance. Dispatch said that the caller wished us to check on her mother who reported to them that a male put a knife to her throat and was screaming she needed help. The male in question had just before this requested a call from me explaining that he and his landlord had been in an argument about rent and she said she was going to call the police on him, but nothing else happened.
 
Other Officers located and detained David at Kwik Shop. The knife David supposedly had was a black steak knife, this weapon was not found near the home, on David, or in his car. David told Officers that Denise is crazy and makes things up and nothing happened besides the rent argument.
 
Based on our findings we have no proof David did what Denise said, therefor I advised all three of them to figure out a plan to keep her so she feels safe, and get David evicted through civil court due to their problems. End report
 
On 06-24-22, Captain. J. Driscoll, was on patrol in the City of Carter Lake.  At 0830, I was traveling South on 17th St approaching Ave O, when I observed a 1992 Lincoln Town car sitting on the side of the road burnt up.  Upon checking CFS log, I found the vehicle fire occurred on 6-23-22 at 1230.  Since the vehicle still hadn't been removed, I called Arrow Towing.  Vehicle registration expired 2 years ago, but I was able to pull owners information off the VIN and it is attached to his report.
 
Arrow arrived at my location and tow truck driver-Troy took possession of the vehicle
 
June 25, 2022
Sgt. Chambers was dispatched to Carter Lake Club to check the welfare on a N. Adams who stated that she had been locked up in her room for three days and only comes out to use the restroom. I made contact with Adams in her bedroom of the residence and she stated that she was having thoughts of hurting herself. I asked her how she planned on doing it and she stated “any way I can.”
 
I asked Adams if she wanted to go to the hospital and talk with a professional and she stated that she did. I gave Adams a ride to Mercy Hospital where she checked herself into the emergency room
 
Officer Bentzinger conducted a traffic stop at 9th and Avenue H on a gray Honda Civic for an illegal pass. After obtaining the driver's, (William Makuon) identification, I learned that his I.D. was suspended with a "pick up" order. I confiscated the I.D. and cited Makuon for no driver's license. June 26, 2022
Officer Dargy was dispatched to a possible burglary in progress. The caller stated they saw a subject breaking into a dark colored SUV in a driveway last seen northbound on 13th Street.
 
On my arrival I spoke with the caller who stated she last saw the person wearing dark sweats headed north. I checked the area for several minutes until I came up on N 11th Street where I saw the lights of an F350 on and legs that were on the passenger side of the truck. As I proceeded to that side, the subject went to the driver’s side, then as I went back to the driver’s side I spotted a male wearing a dark sweatshirt with dark sweatpants and also a back pack.
 
The suspect then bolted over the fence to the backyard, once I got in the backyard I saw him scale another fence. After a search, the suspect was not located.
 
I went back on Dorene and from the initial call location all the way to where I located the suspect I found approximately 9 vehicles that the suspect had gotten into, as of today only one report was made of things actually missing from the vehicles.
 
I was able to make contact with the owner of the Blue F350. I advised him of what happened and I had him go through his truck to see if anything had been taken, he told me there was not anything missing. I was able to make contact with 4 different homeowners and all of which advised me of nothing taken from their vehicles. I currently have two different people who are going to look at video footage from their cameras, they will email me if they have any footage of the suspect.
 
I have no further information at this time and this case remains under investigation
 
Sgt. Chambers was dispatched to Dorene Blvd. for a report of a vehicle burglary. Upon arrival I made contact with D.F. that informed me that his girlfriend, J.G. had left her wallet in the front seat of their 2018 Toyota Highlander that was parked in the driveway.
 
Someone had entered the vehicle and gone through the wallet taking a debit card and three credit cards belonging to J.G. Nothing else was taken or damaged. I advised that they cancel the cards as soon as possible and notify the police department if any attempts to use the cards are made.
 
D.F. informed me that he would get more information about the cards to me at a later time
 
Officer Dargy had a string of vehicle burglaries in the early morning hours in the same area and chased a suspect through yards and was unable to apprehend them. It is believed that the suspect in Officer Dargy's case and this case are the same unknown individual. 
 
Theft of a generator at Mabrey Park. No information on unit. No suspect information
 
Officer Huscroft was on duty for the Carter Lake Police Department. I was dispatched to Lindwood Drive for a theft report. It should be noted, I have been called to this residence several times this year in reference to the homeowner reporting that her neighbor or “a man” is breaking into her residence and stealing or misplacing her things. All of the reports have been unfounded and it is apparent that she suffers from mental health issues. She lives alone and is very paranoid. On 06/20/2022, I responded to her residence because she thought a man was in her backyard and had set off her alarm system. During that incident she told me that she spent $2,000.00 on a new alarm system because she thinks a man (or neighbor) is targeting her house.
 
Upon arrival, I spoke with homeowner, who said when she was in the shower, she placed $87.00 in a small bucket in the shower next to her. Once she got out and got dressed, the $87.00 was missing. She said her neighbor had snuck in through her bedroom window and stolen the money. The window she said he snuck in through was completely covered by blinds, curtains, headboard of the bed, pillows and books. When I told her it was not possible that anyone had come through the window, she said he places all of the items back when he is sneaking out. She also said the other night she looked out the window and saw a man pointing a gun at her. She then locked herself in her bedroom, but did not call 911. She went on to say she caught the same man who comes through her window, tampering with a different window on her house. She said she caught him taking apart the metal window frame with a hammer. By the time she was getting ready to report it to the police, the man had come back and fixed the window frame.
 
Upon looking at the call for service history in Zuercher for the residence on Lindwood Drive, it shows that CLPD has been called there 23 times in 2022. Most of which have been for homeowner thinking a man had been crawling through her window or stealing items from inside of her home.
 
It should also be noted that the inside of her home is extremely cluttered. There is trash, canned food, cat food and other miscellaneous items all throughout the house. In most of the house, there is only a big enough pathway through all of the junk that you can hardly walk through. The kitchen is also overcrowded with food, trash and dirty dishes. It is apparent that she is not physically able or willing to complete routine tasks necessary to live in a safe, clean and clutter free home. Several photos of the interior of the home are attached to this casefile. She did say that she has several people that help her with getting to the doctor when she needs to go and other necessary activities and household chores.
 
This case will be forwarded to Iowa DHS for review. Nothing further
 
Officer Huscroft was on duty for the Carter Lake Police Department. When I arrived to work at 1500 hours, Sgt. Chambers requested I call J.G. who wanted to speak with an Officer about something that had happened in Carter Lake.
 
I called and spoke with J.G. around 1610 hours. She said that on 06/20/2022 around 0400 hours, she woke up to texts from her daughter, J.G. saying that she woke up to her father, S.G. touching her inappropriately. She requested that J.G. come pick her up so she did not have to be with her father any longer.
 
It should be noted that J.G. lives in West Des Moines, IA and father lives in Carter Lake. They have children together and J.G. said there is a court order, stating that S.G. gets the children every other weekend. J.G. primarily lives with J.G. in West Des Moines and is enrolled in school there.
 
J.G. said that after she received the texts from J.G., she sent her boyfriend, J.M. to pick up J.G. from SG.’s. Josh lives near Carter Lake in Omaha, NE. J.G. then drove from West Des Moines to pick up J.G. and take her back home. On their way back to West Des Moines, J.G. said she ended up going to jail. She said after getting out of jail, she contacted Iowa DHS who came to their apartment yesterday (06/25/2022) to speak with them about the alleged assault. When asked about the text messages with J.G., J.G. said that J.G. told her that she woke up to S.G. touching her “over the pants” and as soon as she opened her eyes, he stopped. J.G. said she has already talked to S.G. about the accusations and he has been “freaking out” and denying that anything happened. J.G. said S.G. told her that J.G. must have been dreaming that he had touched her inappropriately because he would never do that. J.G. has since blocked S.G.'s number and hasn't spoken to him.
 
J.G. also stated that they are currently living in West Des Moines, but she is planning on moving back to somewhere in Pottawattamie County within the next month.
 
I also requested that J.G. email me screenshots of the conversation between her and J.G. They will be uploaded to this casefile.
 
At approximately 2100 hours I called and spoke with J.G. again. She said the DHS caseworker is Jean with Polk County DHS (319-334-6091).
 
I will call Jean when I return to work on 06-29-2022 to get more information.

June 27, 2022
In the morning I was approached by a City Parks worker who gave me a set of keys they found that belong to an orange Jeep with Nebraska plates that was sitting in the handicap parking stall. There was a party in the park Sunday morning and it belonged to someone who was in attendance at the party.
 
I handed the keys over to Sgt Gonsior and he was advised.
 
Owner came to Carter Lake Police Department and retrieved keys
 
Officer Matt Owens was on patrol in full uniform and driving a marked cruiser. I observed a blue Chrysler car with no license plates traveling West-bound on Locust Street at the 400 block. The vehicle was being driven by a female with a male front passenger. I activated my emergency lights and conducted a traffic stop at the 600 block of Ave. J.
 
I made contact with the female driver later identified as arrestee Angie Lybarger and the male passenger. I advised them of why I had stopped them and requested to see the bill of sale only for the vehicle. While Lybager was looking for the requested document I asked where they were going and they stated the “Carter Lake casino”. After a few minutes of searching Lybarger located the bill of sale with a sale date of 6-2-22. I observed her name as the buyer and asked if that was her. She stated it was. As my probable cause for the stop was no longer valid I advised them they were free to leave.
 
After Lybarger and the male had left I looked up Lybarger’s name card in Zuercher. The name card had multiple mug shots which matched the female that was operating the vehicle I had stopped. It also showed that she had been arrested in May of 2022 for driving while barred in Council Bluffs. I ran Lybarger’s information through NCIC and her driver’s license still came back as barred. 
 
I proceeded to the Prairie Flower Casino located at 1031 Ave. H along with assisting Officer Adam Swinarski. Casino staff was able to direct me to where Lybarger was. As I approached her I asked what her date of birth was and she stated 6-18-92. I advised her not to lie to me and she then admitted it was her valid birth date. I placed her in handcuffs, checking for a proper fit and double locking them. I told her that her driver’s license was barred. She said that her lawyer sent her a paper saying that her license was only suspended now. I told her that I would double check and walked her out of the casino, placing her in the rear caged portion of my cruiser. I ran her information through NCIC again and it still showed her driving privileges as barred. I told her she was now under arrest for driving while barred. 
 
Officer Swinarski transported Lybarger to the Pottawattamie County Jail where she was booked for driving while barred. Nothing further at this time
   
Officer Matt Owens and Officer Adam Swinarski were dispatched to 109 Locust Street at the Jump Start gas station for a theft that had just occurred. Dispatch advised that a black male in camo shorts, a black shirt and a black hat had just taken a beer, and a red bull out of the store. The suspect was then reported to have dropped the two items and continued running Westbound from this location into Omaha.
 
When we arrived both myself and Officer Swinarski drove to 16th and Locust Street in Omaha to attempt to locate the suspect but were unable to find him. I returned to the Jump Start gas station and met with the manager identified as Christina Raymer.
 
Manager stated that she was working the front counter when she and another employee observed the suspect concealing items on his person. As he attempted to leave the store she advised the suspect to empty his pockets or they would call the Police. The suspect exited the store and began to run. As he was running he dropped a bottle of bud light beer valued at $1.64 and threw a 20 oz. can of Red Bull valued at $3.68. She said the suspect was a black male wearing gray and white camo shorts, a black shirt, black hat and sunglasses, black gloves and gray Air Jordan shoes. He was approximately 5’ 5” tall and weighed between 120 and 140 lbs. After the suspect dropped the two items he ran Westbound up Locust Street to 16th Street in Omaha which is where they lost sight of him. None of the stolen items that were recovered by staff were collected as evidence, and were released back to the business.   
 
Manager was provided a business card with the corresponding case number and told to call 911 if the suspect came back. Nothing further at this time
 
Sgt. was dispatched to Walker Street to take a report of theft of a washer and dryer from a rental home. Sgt. advised landlord that I would look into the tenant/landlord laws and get back to him
 
June 28, 2022
Sgt. Gonsior met with Shoreline Golf Course manager about some damage done to a retaining wall between the first and second hole. Manager showed this officer several pictures of a rail road tie retaining wall between the first and second hole that appeared to have been started on fire. He stated his grounds keeping crew noticed it still smoking this morning around 0800 hours. Damage to the wall is approximately $750.
 
The weather on Monday night was cool and calm with no storms in the area. Jared did not know if any fireworks were around in the area being discharged. The retaining wall is very close to the lake shoreline, approximately 10 yards. It is possible that unknown individual(s) were on the beach area and lit the wall on fire. This officer could also see visible vehicle tire marks around the green area of the course between holes one and two. No suspect information at this time.
 
This officer stopped over at the Carter Lake Ski Club which sits directly to the west of holes one and two. Nobody was on the property at this time. End of report
 
June 28, 2022
Sgt. was dispatched to a theft call in the area of 3510 N 9th Street, Lot 149.  The caller stated she has video of a male party stealing her daughter’s bike and the suspect is now at lot 12.  While I was driving to the call I was flagged down by a female in the middle of 9th Street at the 3500 block.  I pulled into the church parking lot that sits directly across the street from 3510 N 9th Street.  Mom stated she was driving around looking for her daughter’s bike, which they found lying on the ground in the grass by her home.  Investigation continues
 
On June 28, 2022 at approximately 1806 hours I was dispatched to 3510 N. 9th Street Lot #97 for a burglary that was possibly related to case taken by Sgt. Gonsior.
 
Upon arrival I made contact with D. Ramirez and her interpreter. Ramirez does not speak English and this is why she did not stop and talk to Sgt. Gonsior when he was on scene. I did not get the name of the interpreter or the Hispanic male showing the photo of the white Volkswagen. Even with an interpreter it was difficult to get information from Ramirez.
 
Ramirez is concerned and requested extra patrol in the area
 
On June 28, 2022 at approximately 1824 hours Sgt. Chambers was dispatched to Carter Lake Club for a report of threats. Upon arrival I met with the caller who stated that he was assaulted by a male (1) and threatened by another male (2).
 
Shields stated that male (1) sucker punched him in the face and male (2) threatened to cause property damage.
 
I asked what the assault was over and he stated that he is separated from his wife and they are friends of hers and they are “just bullies”.
 
Caller just wanted a report so there was a record in case they came back and something happened. He did not want charges because “it would just make it worse”.
 
Caller could not provide information on the two parties and was unsure of the correct last name of male (2) that made the threats.
 
No further investigation was done due to caller not wanting to cooperate with charging the two
 
June 29, 2022
Sgt. was dispatched to Country Inn & Suites for violation of protective order. While enroute, I was advised the male party came into the hotel to confront a female employee, but left when he learned cops were called.
 
Upon arrival, I made contact with victim, LM.  This officer is familiar with LM and the other party, DP as I have dealt with them several times.  DP currently has a valid protection order against him and several warrants.
LM advised me that DP showed up at the hotel today looking for her.  This is still all over the custody issue they are having about their child.  She states they were in a verbal argument when DP noticed a male employee inside the hotel and left.  As he was leaving the parking lot, he hit a decorative flower pot with his car and destroyed it.  See attached pictures.  He also threw a brick at her car, but it didn’t do any damage. 
 
At this time, the male employee, who wouldn’t identify himself to me, came up and told me about the damage DP did as he left.  He also told me that DP pushed him out of the way and claims DP came at him with his car. I needed to collect his information to verify it and add it to the report, but he refused and left driving the hotel shuttle bus.
 
At this time, I will be requesting a warrant for DP for violation of a protection or and criminal mischief
 
Officer Huscroft was on duty for the Carter Lake Police Department. At approximately 1751 hours, I was dispatched to Mayper Drive for a theft/burglary report.
 
Upon arrival, I spoke with LR who said sometime between 2200-0530 hours last night, someone entered their detached garage behind their house and stole 4 of their chainsaws. She said their daughter was pretty sure the garage was shut, but it might have closed and re-opened without them noticing. The front of the garage is right next to Willow Drive and LR said they sit outside in their garage often, so she thinks the suspect might have already known where the chainsaws were. She said the only thing missing is the chainsaws even though there were several other power tools in the garage. She said the backdoor is usually unlocked, but the only way for someone to gain access to it is to jump the fence to their backyard.
 
She said the chainsaws belong to her husband. He had sent her a text with the brand and model for each chainsaw. They are as follows:

  • Homelite 650 - $470.00
                  Total: $2,540.00
 
They might have a list of the serial numbers for the chainsaws. She was given a business card with the corresponding case number and was told to email me the serial numbers if they can find them. She also said she checked with Sol’s Pawn Shop but nobody has pawned any chainsaws today.
 
She said their neighbor is going to check their security cameras to see if they picked up anything. She will let me know. Investigation continues
 
Officer Huscroft was on duty for the Carter Lake Police Department. At approximately 2058 hours, I received a phone call from Capt. Driscoll who was off duty at the Carter Lake Ball Fields. He advised Daniel Kessler was with Macy Kessler at the fields. He said once Daniel saw him, he and Macy took off running. It should be noted, Daniel has multiple outstanding warrants through Pottawattamie County. There are also several protection orders between Daniel and Macy, with Daniel listed as the defendant and Macy as the protected party.
 
Officers Swinarski, Owens, Dargy, Bentzinger and I all checked the area around N. 15th and Stella Avenue but were unable to locate Daniel. I will be requesting a warrant for Daniel for violation of no contact/protective order.
 
Officer Huscroft was on duty for the Carter Lake Police Department. At approximately 2257 hours, Officers were dispatched to Casey’s General Store for an intoxicated male who had previously stolen alcohol from the store and was now causing a disturbance and refusing to leave. While enroute to Casey’s, dispatch stated that the suspect was now across Locust Street in a physical fight with another male. During this time Officer Dargy advised via radio that one of the males was likely Jacee J. Quick Bear as he had just dealt with him on a prior call.
 
Upon my arrival to the area, a Casey’s employee, MM, said Jacee was fighting another male near 13th and Locust Street next to Fett’s City Motors. Officer Owens #913 and I proceeded to the open field south of the 1400 block of Locust Street. I then observed a shirtless male running southbound through the field towards the Candlewood Suites (2601 Abbott Plaza). I did not see the other male Jacee had been fighting. Officers Bentzinger and Swinarski were able to locate Jacee walking in the parking lot of the Mega Saver (2505 Abbott Plaza). Officers attempted to speak with Jacee as he was walking around the Mega Saver building. It was clear that he was intoxicated as he was crying, slurring his words and was unsteady on his feet. Since we were in Omaha, dispatch had Troopers with the Nebraska State Patrol enroute as well. Jacee was not yet detained as Officers continued to try to speak with him about what had taken place at Casey’s and in the field. It was apparent that he had been in a fight as he had multiple fresh scratches on his body. There was also a small amount of blood coming from his lower lip. Jacee eventually pointed to a cruiser parked near the Best Western Hotel (2510 Abbott Plaza) in Carter Lake and said he wanted to walk over there. Once Jacee walked across Abbott Plaza back into Carter Lake, he was detained in double locked handcuffs. He did not want to be seen by an ambulance. He was then sat in the back of Officer Dargy’s patrol cruiser and spoke with Officer Owens. He told Officer Owens that he fought the other guy because he was “talking shit”.
 
I then returned to my cruiser to run Jacee through NCIC. As I was doing that, Krista LaPointe walked up to the other Officers near the Best Western. Krista is Jacee’s wife. She had come from the tree area near the open field where Jacee had been fighting the other male. Both Jacee and Krista live in the trees along the Missouri River. Officer Bentzinger briefly spoke with her and then sat her in the back caged-portion of my patrol cruiser. He informed me that she was intoxicated. She also told Officer Dargy that she and Jacee had been drinking heavily throughout the day. As soon as she sat in my cruiser, I detected the odor of an alcoholic beverage coming from her. She was also slurring her words as she spoke. She said she and Jacee had been drinking alcohol in Kiwanis Park in Omaha, NE. She then walked over to Casey’s and had no idea that Jacee had been fighting somebody in the open field. Krista submitted to a portable breath test (PBT) and produced a sample of .230 BrAC.
 
Jacee also submitted to a PBT and produced a sample of .307 BrAC.
 
Both Jacee and Krista were transported to Pottawattamie County Corrections where they were booked for Public Intoxication.
 
Officers attempted to go back to Casey’s to speak with them about the disturbance but they had closed for the night.
 
The male Jacee had been fighting was not located. Nothing further.
 
June 30, 2022
Officer Huscroft was dispatched to the Jump Start gas station (109 E. Locust St) for a shoplifter. Dispatch stated a black female in yellow pants stole items from the store and was still standing in the parking lot.
 
Upon arrival, I had contact with the suspect, Ieisha M. Coleman in the parking lot. She was holding a partially drank yellow Gatorade. An employee was pointing at Ieisha and said she had stolen the yellow Gatorade. She said Ieisha had come with other people in a maroon sedan, but they left her when they found out she was stealing.
 
I also spoke with another employee. He said Ieisha grabbed a yellow Gatorade from the cooler and then began yelling and grabbing her back as if it hurt, but she was actually concealing the Gatorade under her shirt. Once she walked out to the parking lot, employee said they were calling the police. Ieisha then began to drink the Gatorade. It was valued at $3.49. Employees said they wanted to press theft charges on Ieisha and ban her from the store.
 
Ieisha was issued a criminal citation for Theft 5th. A court date of 07/07/22 was given with a time of 0900 hours. She was also issued a ban and bar, banning her from the Jump Start for life. I explained the citation and ban and bar to her and she did sign them. She was given a courtesy ride to the Sienna Francis House. Nothing further.
 
At 20:07 hours Officer Bentzinger was dispatched with Officer Huscroft to 3510 N. 9th St. trailer for a report of an abandoned juvenile. Upon arrival we met with the callers, the Myers. The couple stated that juvenile K.V. had been kicked out of her home and had been living in an abandoned trailer house. K.V. was with the Myers. 
 
K.V. stated that she was living with her mother and younger brother. K.V. stated that a couple days before they were due to be evicted from the trailer park, that she had an argument with her mother over Face Book Messenger which ended in her mother kicking her out of the house and so she went to stay with friends in Omaha. K.V. stated that after eventually being kicked out of her friend’s house in Omaha, she walked back to Lot #90 in the trailer park. At that time the trailer was trashed and abandoned. K.V. stated that she had been staying there for approximately one week prior to my involvement and relying on friends to provide her with food and drink. K.V. estimated that she had been kicked out between 45-60 days prior to my involvement. K.V. was able to provide screen shots of the argument that lead to mother kicking her out which I have logged into evidence. The text clearly shows that K.V. was not welcome back in the home as mother states in the text, "You will have your belongings on the porch when you get back and my house will be off limits and am fkn done dealing with you since you are completely grown...DO YOU!". 
 
Officer Huscroft departed to investigate the conditions of lot #90 (see Huscroft's supplemental narrative). 
 
I attempted to contact mother by phone and had to leave a message. I contacted the Iowa Department of Human Services via their emergency hotline to report the abandonment. D.H.S. accepted the case and provided incident #2022181153. While on the phone reporting the incident, mother called and spoke with Officer Huscroft. At that time mother was willing to pick up K.V. from our location. D.H.S. was not opposed to K.V. returning to mother at that time, as they didn't feel as if K.V. would be in any imminent danger. Huscroft further discovered that mother was served a 3 day eviction notice on June 3rd, 2022. mother admitted to kicking out K.V. on June 5th (note that this contradicts K.V.'s estimation of 45-60 days). mother's last communication with K.V. was on June 14th via Face Book Messenger. Both parties claim that the other blocked them after that time.
 
I transported K.V. to lot #90 to collect her personal items. I observed the trailer to be in deplorable conditions. Immediately after walking in the door I was hit with the odor of rotten food and potentially the decay of an animal. The trailer had trash left all over. There was no power but did have running water. It should be noted that there was no temperature control in the trailer and temperatures were reaching into the 80's and 90's over that last week. I followed K.V. to a back bedroom where I observed a spot on the floor where she had a blanket and a large stuffed animal which was presumably used as a pillow based on its’ placement. 
 
I then transported K.V. to the Carter Lake Police Station. Officer Huscroft and I were determining the best course of action with regards to whether K.V. should go with her mother or be taken to Children's Square. After convening with our Command Staff, I attempted to call Children's Square with no answer. At that time mother arrived at the station. K.V. was released to mother and they departed property. End Report. 
 
Officer Bentzinger will be requesting a warrant for mother for child endangerment–deprive necessary care. Nothing further at this time.
